What data we process in an auction, and why
An auction cannot be run anonymously. The law sets out exactly who must be notified, what the notice must contain and what goes into the notarial record. So we process personal data in an auction — not because we want to, but because without it the auction would not stand.

2. Purpose and legal basis
We process data so that a voluntary auction can be prepared and carried out and the underlying debt resolved. The legal basis is chiefly compliance with legal obligations under Act No. 527/2002 Coll. on voluntary auctions — Art. 6(1)(c) GDPR.
Where processing does not follow directly from the law, we rely on performance of a contract with the petitioner or the successful bidder — Art. 6(1)(b) GDPR — or on legitimate interest under Art. 6(1)(f) GDPR, for instance in recovering the debt and keeping records of correspondence. We ask for consent only where no other basis exists; such consent can be withdrawn at any time.
Providing data required by law is not optional — without it, the auction cannot proceed.
3. Categories of data processed
- Identification data: name, date of birth, birth number, permanent address
- Contact data: phone number, e-mail address, correspondence address
- Property data: title deed number, cadastral area, parcel number, shares
- Debt data: amount, due date, payments, correspondence about the debt
- Bidder data: identity document, proof of deposit, bank details
- Auction records: entry in the bidder list, the notarial record
The scope depends on your position — we need different data from a debtor than from a bidder.
4. Who we share the data with
- The notary certifying the course of the auction
- The expert preparing the property appraisal
- The Notarial Chamber of the Slovak Republic — the Central Notarial Register of Auctions (publication of the notice)
- The district office, land registry department — for the change of title
- The auction petitioner (for example a flat owners' association) and lien creditors
- Courts, law enforcement and other public authorities where they request it on a legal basis
- Lawyers, banks and IT service providers to the extent needed to run the auction
We do not transfer data to third countries outside the European Economic Area and do not use it for automated decision-making or profiling.
5. How long we keep the data
We keep data for the period required by the voluntary auctions act, the act on archives and records and accounting rules, and further for as long as claims arising from the auction may be raised. After that, the file is disposed of under the records schedule. We'll tell you the specific period for your case on request.
6. Your rights
Access
You may ask for confirmation whether we process data about you and for a copy of the data we hold.
Rectification
If the data are inaccurate or incomplete, we will correct or complete them.
Erasure
We erase data once the purpose has ceased and no legal duty stands in the way. With auctions such a duty often persists — then we cannot erase and will explain why.
Restriction
You may ask us to hold off working with the data temporarily — for example while their accuracy is checked.
Objection
You may object to processing based on legitimate interest. We will assess the objection and reply.
Portability
Data you gave us on the basis of consent or a contract will be provided in a commonly used format.
