Voluntary auctions

Selling property under clear rules and a fixed date

A voluntary auction is a public sale of property under Act No. 527/2002 Coll. on voluntary auctions. It is not ordered by a court or a bailiff: it is petitioned by the owner, or by a creditor holding a lien recognised by law — typically a housing association dealing with a long-standing defaulter.

Everything is published in advance: the date, the venue, the reserve price and the viewings all appear in the auction notice in the Central Notarial Register of Auctions. The highest bidder wins the knockdown and becomes the owner.

The process

From petition to keys in six steps

This is an informative overview. What binds is always the wording of the individual auction notice.

The petition

The owner, or a creditor with a lien recognised by law, petitions for the auction and documents the debt and the property.

The appraisal

An expert values the property. That value sets the reserve price — the figure bidding cannot go below.

The auction notice

Published in the Central Notarial Register of Auctions and served on the parties concerned. It states the viewing dates, the deposit and the accounts it goes to.

Viewings

Held on the dates given in the notice. Anyone considering the property may come — with no payment of any kind up front.

The auction and the knockdown

The auctioneer calls for bids. The highest bidder wins the knockdown and becomes the successful bidder.

Payment and transfer of title

The winner pays the balance within the period set by the notice. Title passes at the knockdown; the land registry is updated from the notarial record.

Important warning — beware of fraud

  • Paying the auction deposit is never a condition of viewing a property. If someone asks you for money in exchange for access to a property, you are not dealing with the auctioneer.
  • Viewings take place only on the dates stated in the auction notice. We arrange no “private” viewings outside them.
  • The deposit may only be paid to the accounts stated in the auction notice itself. Never to an account someone texts you, e-mails you or dictates over the phone.
